- New servers running Windows Server 2022 with Hyper-V, sized for the EHR and imaging workloads with room for two more locations
- Firewalls at all seven sites, joined in an encrypted site-to-site VPN mesh with access granted by role
- Encrypted backups with offsite copies, a documented recovery time and recovery point for each system, and restores tested on a schedule

New York rules for Westchester dental practices
HIPAA (45 CFR Parts 160 and 164)
A dental office that files claims electronically is a covered entity. The Security Rule expects a documented risk analysis, unique logins, audit controls and a contingency plan backed by restorable data. After a breach, patients must be told within 60 days of discovery, and HHS is notified too.
NY SHIELD Act (GBL §899-aa and §899-bb)
New York's breach law counts medical and health insurance information as private information and requires notice to affected residents within 30 days of discovery. A HIPAA covered entity that reports a breach to HHS must also notify the state Attorney General within five business days. Under §899-bb, a practice in compliance with HIPAA is treated as meeting New York's safeguards requirement.
Patient records: Board of Regents Rules §29.2(a)(3)
New York licensees, dentists included, keep patient records for at least six years; for a minor, at least six years and until one year after the patient turns 21. Charts and radiographs have to outlast server failures, software changes and ransomware.
