Since July 1, 2023, New York attorneys have needed at least one CLE credit in Cybersecurity, Privacy and Data Protection each biennial cycle, a first among the states. Its topics, from vendor vetting to breach response, mirror a firm's IT program.
NY Rule 1.6(c)
Lawyers must make reasonable efforts to prevent unauthorized access to, or inadvertent disclosure or use of, information about current, former and prospective clients. In practice: MFA, access by matter, encrypted devices and a record of who opened what.
SHIELD Act safeguards, GBL §899-bb
A small business (under 50 employees, under $3 million in gross annual revenue in each of the last three fiscal years, or under $5 million in year-end total assets) may scale its safeguards to its size and its data. They still have to exist.

Affected New York residents must be told within 30 days of a breach being discovered, a deadline added in December 2024. The Attorney General, the Department of State and the State Police are notified too, and the Department of Financial Services as well when the firm is a DFS-covered entity.
