Mineola, Riverhead, Central Islip and the home office

New York rules for Long Island practices
NY Rule 1.6(c) and NYSBA Ethics Opinion 842
Rule 1.6(c) requires reasonable efforts to prevent unauthorized access to client information. NYSBA Opinion 842 (2010) allows online storage of client files with reasonable care, including a provider bound to confidentiality that will notify the firm if served with process.
Rule 1.15 and escrow funds
Rule 1.15 makes the attorney responsible for safeguarding client and escrow funds. A spoofed payoff letter or a changed wire instruction puts those funds at risk, which is why closing procedures need a phone verification step.
SHIELD Act, GBL §899-aa and §899-bb
Firms holding New York residents' private information need reasonable safeguards and must notify affected residents within 30 days of discovering a breach. Since March 2025, private information includes medical and health insurance information, which personal injury files hold in quantity.
HIPAA, when a client is a health care provider
A firm receiving protected health information to do legal work for a hospital, practice or health plan is a business associate (45 CFR 160.103) and needs an agreement plus Security Rule safeguards (45 CFR Part 164, Subpart C).
