New Jersey rules that shape a firm's IT
RPC 1.6(f) and the technology CLE
Since 2016, RPC 1.6(f) has required reasonable efforts to prevent the inadvertent or unauthorized disclosure of, or unauthorized access to, information relating to a client's representation. From January 1, 2027, attorneys also need one technology CLE credit per two-year cycle.
ACPE Opinion 701 (2006)
Electronic storage of client files is allowed when lawyers take reasonable affirmative steps: vendors with an enforceable duty to keep data confidential and secure, and available technology used against foreseeable intrusions. Original wills and deeds must still be kept.
Court Rule 1:38-7
Attorneys must redact confidential personal identifiers, such as Social Security, driver's license and financial account numbers, before filing. That calls for a redaction tool that removes the text, not a black box drawn over it.
Breach notice, N.J.S.A. 56:8-163
A breach of personal information is reported to the Division of State Police before affected New Jersey residents are told, and they are then told in the most expedient time possible. A user name or email address with its password counts as personal information.
