NY Rules of Professional Conduct, Rule 1.6(c)

New York's rule (22 NYCRR Part 1200) requires reasonable efforts to prevent the inadvertent or unauthorized disclosure or use of, or unauthorized access to, information protected by Rules 1.6, 1.9(c) and 1.18(b): current, former and prospective clients alike.

ABA Model Rule 1.6(c) and Formal Opinion 483

The ABA's version of the duty is read alongside New York's. Formal Opinion 483 (2018) expects lawyers to monitor for intrusions, stop a breach and tell current clients when their material confidential information is involved.

NY SHIELD Act, GBL §899-aa and §899-bb

§899-bb requires reasonable safeguards for New York residents' private information. Since December 2024, §899-aa requires notice to affected residents within 30 days of discovering a breach. The Attorney General, the Department of State and the State Police are told as well, and the Department of Financial Services when the firm is a DFS-covered entity.

Clients regulated under NYDFS 23 NYCRR 500

Banks and insurers licensed by the Department of Financial Services must apply a security policy to service providers that hold their nonpublic information (§500.11). Outside counsel often qualifies, which is where many client questionnaires come from.
