The Security Rule requires a risk analysis (§164.308(a)(1)(ii)(A)) covering every office and the links between them, unique user logins and audit controls (§164.312), and a business associate agreement with any vendor that creates, receives, maintains or transmits patient data for the practice, its IT provider included (§164.308(b)).
NY SHIELD Act (GBL §899-aa and §899-bb)
If a breach must be reported to HHS under HIPAA, §899-aa(9) requires the practice to send that notification to the New York Attorney General within five business days of notifying HHS. When New York residents are notified, §899-aa(8) adds notice to the Attorney General, the Department of State and the State Police.
