Which rules apply to NYC financial firms

NYDFS 23 NYCRR 500

Covers any firm that holds, or needs, a license, registration or charter under New York's Banking, Insurance or Financial Services Law. Since November 1, 2025, multifactor authentication is required for anyone signing in to a covered firm's systems, and a documented asset inventory must be kept. Cybersecurity incidents go to DFS within 72 hours, and the annual compliance filing is due April 15.

SEC Regulation S-P (amended 2024)

Covers SEC-registered advisers, broker-dealers, investment companies, funding portals and transfer agents. The amended rule asks for an incident response program in writing, a 30-day deadline for telling customers their sensitive information was reached without authorization, and contracts that make service providers report a breach inside 72 hours. Larger firms have complied since December 3, 2025, smaller ones since June 3, 2026.

FTC Safeguards Rule (16 CFR Part 314)

Covers non-bank financial institutions such as mortgage brokers, finance companies, check cashers and advisers not required to register with the SEC. The rule requires a written information security program under a Qualified Individual, MFA, encryption and vendor oversight, and a report to the FTC within 30 days when unencrypted information on 500 or more consumers is acquired without authorization.

NY SHIELD Act (GBL §899-aa)

A breach of New York residents' private information must be disclosed to them within 30 days of discovery and reported to the Attorney General, the Department of State and the State Police, and to DFS when the firm is a Part 500 covered entity.
